No, NC does not consider it a moped. YOU consider it a moped.
Just because "100 policeman" in your area aren't bothered by it, does NOT make it legal. It just makes you fortunate is all.

-You've got an external shifting device...Strike one.
-It's faster than 30 mph......Strike two.
And when they clock you doing more than 30, there won't be anything you can really say to justify that.
-It's more than 50ccs. They probably wouldn't go as far as to verify the cc's since it's stamped 49, but it's possible if they decide to be really anal and impound it. Besides, you know it's more than 50cc's .....Strike three.
It's great they don't bother you where you live, but just be aware that NC police officers "legally" can rip you a new one if they wanted to. Hopefully you won't encounter the anal ones, but just be aware that they can. And please, try not to mis-inform others.
